FitMat Warranty Registration

• This limited product Warranty extends to products manufactured by Fitmat, purchased directly from Fitmat or online marketplaces only in India.
• All Fitmat warranties, including any implied warranties, are valid only for the period of time the product is owned by the original purchaser of the product. The“ original purchaser,” for the purposes of this Product Warranty, is the first purchaser of the product from Fitmat or Fitmat authorized retailer. Please retain a copy of your receipt as proof of purchase. All Fitmat limited warranties are not transferable.
• This Limited Warranty covers any defects in material or workmanship under normal use during the Warranty Period. During the Warranty Period, Fitmat will repair or replace, products that prove defective because of improper material or workmanship, under normal use and maintenance.

Fitmat warrants the memory foam product in its original packaging sold to you against defects in material and workmanship set forth below (“Defects”) for a period (warranty duration specified with product ) from the time your product is purchased by you, when the product is used normally for its intended purposes.

The Warranty Period for Physical Goods purchased from Fitmat is 1 years to 3 years ( as per product catalogue) from the date of purchase. A replacement Physical Good or part assumes the remaining warranty of the original Physical Good.

This Limited Warranty does not cover any problem that is caused by:

• Normal increases in softening and settling of materials, or any other normal wear and tear.
• Comfort preference.
• Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
• Any product (whether manufactured by Fitmat or not) sold by resellers who are not authorized retailers.
• Wear & Tear of Outer Cover Which Includes the Zip, Staining, Shrinkage or Any Other Fabric Issues.

In the event of a Defect, Fitmat’s sole and exclusive liability and your sole remedy under this limited product Warranty will be, at Fitmat’s option, to provide a repaired or replacement product, subject to fulfillment of “Your Responsibilities” below.

To obtain warranty service, you must first contact us at fitmatindia@gmail.com to determine the problem and the most appropriate solution for you.

In the event of a Defect and in order to get the benefit of this limited product Warranty, you must return your product to Fitmat and provide Fitmat with proof of the original date of purchase. Should shipping costs be required to return your product, you will be responsible for those costs. Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited product Warranty. Fitmat will repair or replace (as applicable)  or refund and ship your product back to you. Replaced or repaired products are subject to the same limited product Warranty as the original product. If you obtain a replaced or repaired product, the warranty term of the replaced or repaired product begins from the date of purchase of the original product.

To the extent permissible by applicable law, the product is provided “as is” and this warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from state to state and jurisdiction to jurisdiction. To the maximum extent permitted by applicable law and except as set forth in this limited product warranty, in no event will Fitmat or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if Fitmat has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. Fitmat total liability will not exceed the purchase price paid for the product-giving rise to such liability. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.

This limited product Warranty Will be governed by and construed in accordance with the laws of the India and shall be subject to the non-exclusive jurisdiction of the courts of Ambala, India.
